Our website is powered by Shopify, which provides the platform used to operate and manage this website. When you choose to purchase a book, you may be redirected to the Lulu Bookstore, where the purchase, payment, printing, fulfillment, and shipping of the order are handled by Lulu.

The terms and conditions below, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you access or use the Services.

When you choose to purchase a book through the Lulu Bookstore, you may be required to provide additional billing, payment, and shipping information directly to Lulu. Information provided to Lulu for a purchase is subject to Lulu’s applicable terms and privacy policies.

If you create an account on our website, you are responsible for maintaining the security of your account credentials and for activity associated with your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to provide accurate information and images of our products on our website. However, colors and product appearance may vary slightly depending on your device, screen settings, and other technical factors.

Our books are produced through print-on-demand by Lulu. Minor variations in color, ink coverage, alignment, or printing may occasionally occur. Such minor variations that do not affect the usability of the book may not be considered manufacturing defects.

We do not guarantee that the colors or appearance of a product will exactly match how they appear on your screen.

Product descriptions, images, specifications, and availability may be updated or changed from time to time. We reserve the right to modify, discontinue, or limit the availability of products when necessary.

Purchases of our books through the Lulu Bookstore are subject to Lulu’s applicable terms, policies, and procedures, including those relating to production, availability, shipping, cancellations, returns, replacements, and refunds.

Nothing in these Terms affects any rights or protections that cannot be excluded under applicable law.

SECTION 3 - ORDERS

When you choose to purchase a Noosta book, you will be redirected to the Lulu Bookstore to complete your purchase. The purchase agreement, payment, order processing, printing, fulfillment, and shipping of the book are handled by Lulu in accordance with Lulu’s applicable terms and policies.

Please review your order carefully before completing your purchase, including the product, quantity, shipping address, and contact information. Because books are produced through print-on-demand, cancellation requests should be submitted to Lulu as soon as possible after placing an order. Lulu’s applicable cancellation policy will determine whether an order can be cancelled once it has entered production or has been sent to the printer.

Lulu may decline, cancel, or modify an order when necessary, including in cases involving payment issues, incorrect information, product availability, pricing or technical errors, or suspected fraudulent activity. Any applicable refund or other resolution will be handled by Lulu in accordance with its policies.

Returns, replacements, refunds, and order cancellations for purchases made through the Lulu Bookstore are subject to Lulu’s applicable policies.

You represent and warrant that your purchases are for your personal or household use and are not intended for unauthorized commercial resale.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions for our books may change from time to time without notice. The price applicable to a purchase will be the price displayed on the Lulu Bookstore at the time the order is placed.

Unless otherwise stated at checkout, product prices do not include shipping costs or any customs duties, import taxes, or other charges that may be imposed by the destination country or local authorities.

Shipping costs and any applicable charges will be displayed by Lulu at checkout where available.

We may offer promotions or discounts from time to time. Promotional offers may be subject to additional terms and conditions. If there is a conflict between the terms of a promotion and these Terms of Service, the promotional terms will apply to that promotion.

When completing a purchase through the Lulu Bookstore, you are responsible for providing accurate, complete, and current billing, payment, shipping, and contact information to Lulu. You agree to update this information when necessary so that Lulu can process and fulfill your order.

By submitting an order through the Lulu Bookstore, you confirm that you are authorized to use the payment method provided and agree to pay all charges associated with your purchase, including the product price, applicable shipping charges, taxes, and other charges shown at checkout.

SECTION 5 - SHIPPING AND DELIVERY

Books are produced on demand by Lulu before being shipped. Production normally takes 3–5 business days, after which the order is shipped using the shipping method selected or available at checkout.

Delivery times are estimates only and may vary depending on the destination, shipping method, carrier, customs processing, and other circumstances outside Lulu’s or Noosta’s reasonable control.

Noosta is not responsible for delays caused by shipping carriers, customs authorities, incorrect or incomplete delivery information provided by the customer, or events beyond our reasonable control.

Once an order has been shipped, tracking information may be provided by Lulu when available.

If your order is significantly delayed, does not arrive within a reasonable period, or arrives damaged, please contact Lulu Support with your Lulu order number. You may also contact Noosta for general assistance regarding your order or our products.

Nothing in this section limits any rights or protections that cannot be excluded under applicable law.

SECTION 6 - INTELLECTUAL PROPERTY

All content and materials available through our Services, including but not limited to the Noosta name and logo, product names, book designs, illustrations, artwork, text, graphics, photographs, images, videos, audio, website design, and the selection and arrangement of such materials, are owned by Noosta or used with permission and are protected by applicable intellectual property laws.

You may access and use our Services for your personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, publish, transmit, display, sell, create derivative works from, or otherwise use any content from our Services without our prior written permission, except where permitted by applicable law.

Purchasing a Noosta book does not transfer ownership of or any intellectual property rights in the artwork, illustrations, designs, text, or other creative content contained in the book. Books are purchased for personal use unless otherwise authorized by Noosta.

No license or other rights to any trademark, copyright, design, or other intellectual property owned by Noosta are granted to you except as expressly stated in these Terms or as required by applicable law.

The Noosta name, logo, product names, designs, and slogans are trademarks or brand assets of Noosta. You may not use them without our prior written permission.

Shopify's name, logo, and other trademarks belong to Shopify. Lulu's name, logo, and other trademarks belong to Lulu. Other names, logos, trademarks, and materials appearing on our Services belong to their respective owners.

All rights not expressly granted in these Terms are reserved by Noosta.

SECTION 7 - OPTIONAL TOOLS

Our Services may provide access to certain tools, features, or services offered by third-party providers. These third-party services are not controlled or operated by Noosta, and we may not monitor or control their availability, functionality, security, or content.

Any third-party tools made available through our Services are provided on an “as is” and “as available” basis, subject to the terms and conditions of the relevant third-party provider.

Your use of third-party tools is at your own discretion and may be subject to additional terms imposed by the applicable third-party provider. We may introduce new features, tools, or resources through our Services from time to time. Any new features or tools will also be subject to these Terms of Service unless otherwise stated.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Noosta’s website is powered by Shopify, which provides the platform used to operate and manage our website and Services.

Shopify is not the seller of our books and does not process purchases made through the Lulu Bookstore. When you choose to purchase a Noosta book, you may be redirected to Lulu, where the purchase, payment, printing, fulfillment, and shipping of the order are handled by Lulu.

Shopify is not responsible for transactions, products, fulfillment, shipping, refunds, replacements, or other matters relating to purchases made through the Lulu Bookstore.

Your use of Shopify-powered features on our website is subject to Shopify’s applicable terms and policies. Your purchases through Lulu are subject to Lulu’s applicable terms, policies, and procedures.

Nothing in these Terms affects any rights or protections that cannot be excluded under applicable law.

All personal information we collect through the Services is handled in accordance with our Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

You represent and warrant that you have the necessary rights to provide your Feedback and that it does not infringe the rights of any third party or violate any applicable law.

If an error or inaccuracy affects a purchase made through the Lulu Bookstore, the applicable correction, cancellation, or other resolution will be handled by Lulu in accordance with its applicable policies. If necessary, you may be contacted through the information provided during the purchase.

Noosta is not responsible for errors, inaccuracies, or omissions in information or services provided directly by third-party providers, including Lulu, except where otherwise required by applicable law.

We are not required to update, amend, or clarify information unless required by applicable law.

Termination or suspension of access to the Services does not affect any rights or obligations that arose before the termination. Any purchases or orders made through the Lulu Bookstore remain subject to Lulu’s applicable terms and policies.

Any provisions of these Terms that by their nature should continue after termination will remain in effect, including provisions relating to Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that are intended to survive termination.

Our books are produced and fulfilled through Lulu. Purchases made through the Lulu Bookstore are subject to the product descriptions, policies, and terms applicable to those purchases. Nothing in these Terms excludes or limits any warranty, guarantee, consumer right, or protection that cannot lawfully be excluded or limited under applicable law.

Where a book purchased through the Lulu Bookstore arrives damaged, defective, or otherwise does not conform to applicable requirements, please contact Lulu Support with your Lulu order number so that Lulu can review the issue and determine the appropriate resolution in accordance with its applicable policies.

To the fullest extent permitted by applicable law, Noosta will not be responsible for losses arising from circumstances outside our reasonable control, including interruptions to the Services, shipping delays, carrier issues, customs processing, or events beyond our reasonable control.

Noosta is not responsible for the acts, omissions, policies, performance, or services of third-party providers, including Shopify and Lulu, except where otherwise required by applicable law.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under applicable law, including any rights or protections that apply to consumers.

Where a book purchased through the Lulu Bookstore is damaged, defective, incorrect, or otherwise does not conform to applicable requirements, your rights and available remedies are subject to Lulu’s applicable policies and applicable law.

SECTION 17 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Noosta, its owners, affiliates, employees, agents, contractors, service providers, and licensors from reasonable losses, liabilities, damages, and claims arising directly from:

(a) your material breach of these Terms of Service;

(b) your unlawful or fraudulent use of the Services; or

(c) your violation of the rights of Noosta or a third party.

Noosta will provide you with reasonable notice of any claim for which indemnification is sought, where applicable. We may participate in the defense of such a claim, and you agree to provide reasonable cooperation and information necessary to address the claim.

Nothing in this section requires you to indemnify Noosta for losses caused by Noosta's own unlawful conduct, negligence, or breach of these Terms, to the extent such limitation is required by applicable law.

SECTION 18 - SEVERABILITY

If any provision of these Terms of Service is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law, and the unenforceable portion will be considered severed from these Terms.

The remaining provisions of these Terms will continue in full force and effect.

If we do not exercise or enforce any right or provision of these Terms of Service, this does not constitute a waiver of that right or provision.

These Terms of Service, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any other policies or rules posted on our website, constitute the entire agreement between you and Noosta regarding your use of the Services and supersede any previous or contemporaneous agreements, communications, or proposals relating to the Services.

Purchases made through the Lulu Bookstore are also subject to Lulu’s applicable terms, policies, and procedures. These Terms govern your relationship with Noosta regarding your use of our Services and do not replace or modify the terms governing your transactions with third-party providers.
